Terms of Service

These Terms govern all projects and services provided by Pixela ("we", "us") to clients ("you"). By commissioning work from Pixela, you agree to these Terms.

1. Scope of Services

We provide web design, web development, and website maintenance services as agreed in writing (email or project brief) before work begins. Any additional features or pages outside the agreed scope will be quoted separately.

2. Payment Terms

  • 50% upfront before any design or development work begins.
  • 50% on final delivery — before the site files or access credentials are handed over.
  • Invoices are due within 7 days of issue. Late payments incur a 1.5% monthly fee.
  • All prices are in USD unless otherwise stated in the project brief.

3. Revision Policy

  • All packages include 2 rounds of revisions.
  • Additional rounds are billed at $75/hour.
  • Revisions must be requested within 14 days of delivery.
  • A "revision" means changes within the agreed scope — not new features or redesigns of approved elements.

4. Intellectual Property

Upon receipt of final payment, you receive full ownership of all custom code, design assets, and content created for your project. Pixela retains the right to display the project in its portfolio and case studies unless you request otherwise in writing.

Any third-party assets used (stock photos, fonts, plugins) are subject to their own licences — you are responsible for maintaining those licences after handoff.

5. Client Responsibilities

Timely delivery of content, feedback, and approvals is essential. Delays caused by the client (e.g. not providing copy or images for more than 14 days) may result in the project timeline being extended accordingly, or a restart fee of 15% of the project value.

6. Cancellation & Kill Fee

  • If you cancel after work has begun, the 50% upfront payment is non-refundable.
  • If we cancel for reasons within our control, we will refund the upfront payment in full.

7. Hosting & Domain

We do not provide hosting or domain registration unless explicitly agreed. We will help you set these up but are not liable for third-party hosting downtime, data loss, or security issues once the site is deployed.

8. Limitation of Liability

Our total liability for any claim arising from a project is limited to the amount you paid for that project. We are not liable for indirect losses including lost profits, lost data, or business interruption.

9. Confidentiality

We treat all project details, business information, and client data as confidential and will not share them with third parties without your consent, except where required by law.

10. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes will be resolved through good-faith negotiation first; if unresolved, through binding arbitration in Karachi.

11. Changes to These Terms

We may update these Terms. Changes apply to new projects starting after the update date. Existing projects continue under the Terms in force at the time the project was agreed.
